The Big News: Nationwide Injunction Stops BOI Enforcement


On December 3, 2024, a federal judge in Texas issued a nationwide injunction that pauses the Corporate Transparency Act (CTA) enforcement. This means the BOI reporting requirements are no longer enforceable—for now. The ruling declared the law unconstitutional due to overreach and privacy concerns, something I’ve been saying all along.


The CTA required businesses like LLCs to report their owners' (BENEFICIARIES) personal details to the government via FinCEN (the Financial Crimes Enforcement Network). It was meant to fight money laundering but was considered invasive, especially for small businesses like yours.

What This Means for Small Business Owners


  1. You Don’t Have to File BOI Reports Right Now. The January 1, 2025, deadline is officially paused. If you were scrambling to prepare, take a deep breath—you don’t need to act at this moment.

  2. This Isn’t Permanent. The injunction is a temporary pause. The federal government could appeal the ruling and reinstate the requirements, so stay alert. I’ll keep you updated here at CEO DRIVEHER.

  3. Existing Businesses Are Safe (For Now). If your LLC was created before January 1, 2024, you no longer have the looming deadline. Those who formed businesses after that date also don’t need to worry about the 90-day reporting window.

  4. Privacy Is Back—For Now. The BOI requirements demanded sensitive personal information, such as your name, address, and even a unique identifying number like your driver’s license or passport. This pause is a step toward protecting your sovereignty and business privacy.


Why I Was Right: A Flashback


I’ve been warning you about the overreach of BOI reporting for years. I told you not to rush into filing and to wait until the last minute. Why? Because the policy felt more like a totalitarian overstep than a tool to fight crime. Now, this ruling echoes the same concerns I’ve been raising—overreach, unconstitutionality, and invasiveness.


What Should You Do Now?


  1. Stay Informed. This injunction is a temporary victory. Follow updates here on CEO DRIVEHER or credible news sources.

  2. Protect Your Data: Avoid sharing sensitive business information unless absolutely necessary. Predatory consultants are charging high fees for BOI filings even though the process is currently FREE on FinCEN’s website and unnecessary.

  3. Hold the Line: If you haven’t filed yet, don’t! There’s no action required right now. Compliance may be reinstated later, but you’re off the hook for now.
